By accessing and using LuxeShop ("the Service"), you accept and agree to be bound by these Terms and Conditions. If you do not agree to these terms, please do not use our service. These terms apply to all visitors, users, and others who access or use the Service.
2. User Accounts
When you create an account with us, you must provide accurate, complete, and current information. You are responsible for safeguarding your password and for any activities or actions under your account. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.
3. Products and Pricing
We reserve the right to modify or discontinue any product at any time without notice. Prices for products are subject to change without notice. We shall not be liable to you or any third party for any modification, price change, suspension, or discontinuation of the Service. All prices are displayed in USD.
4. Orders and Payment
We currently accept Cash on Delivery (COD) as our payment method. By placing an order, you confirm that you will have sufficient cash to pay upon delivery. We reserve the right to refuse or cancel your order if we suspect fraud or unauthorized activities. Orders can only be cancelled before they are shipped.
5. Shipping and Delivery
We aim to deliver all orders within 3-7 business days. Delivery times may vary based on your location and other factors. Shipping costs are calculated at checkout. Orders over $50 qualify for free shipping. We are not responsible for delays caused by circumstances beyond our control.
6. Returns and Refunds
You may return most items within 30 days of delivery for a full refund. Items must be in their original condition, unused, and in original packaging. Certain products such as perishables, intimate items, and digital downloads are not eligible for return. Refunds will be processed within 5-10 business days.
7. Intellectual Property
The Service and its original content, features, and functionality are and will remain the exclusive property of LuxeShop. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of LuxeShop. You may not reproduce, duplicate, or copy any content from our website.
8. Prohibited Activities
You may not use the Service for any unlawful purpose, to solicit others to perform unlawful acts, to violate any regulations or laws, to transmit spam or unsolicited communications, to impersonate any person or entity, or to introduce malicious code or interfere with the proper functioning of the Service.
9. Disclaimer of Warranties
The Service is provided on an "AS IS" and "AS AVAILABLE" basis without any warranties of any kind, either express or implied. LuxeShop does not warrant that the Service will be uninterrupted, error-free, or free of viruses or other harmful components. You use the Service at your own risk.
10. Limitation of Liability
In no event shall LuxeShop be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising out of or in connection with your use of the Service. Our total liability shall not exceed the amount you paid for the specific order giving rise to the claim.
11. Governing Law
These Terms shall be governed and construed in accordance with the laws of the State of New York, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in New York County, New York.
